Both the Civil Miscellaneous Applications have been filed seeking to restore the two Second Appeals which have been dismissed on 15.03.2022, since steps have not taken to bring on record the legal heirs of the 2nd appellant.
2. It is seen that the Second Appeal had been admitted and substantial questions of law had also been framed. It is only appropriate that the Court answer the said substantial questions of law.
3. In view of that particular reasons, the order of the dismissal is set aside. The two Civil Miscellaneous Applications are allowed. However, list the Second Appeals once again on 27.07.2022 for the appellant to file necessary applications with respect to bringing on record the legal heirs of the deceased 2nd appellant. If such applications are not filed within the particular date, further orders adverse to the appellant shall again be passed.
