Government Advocate (Crl. Side) COMMON ORDER These Criminal Original Petitions have been preferred seeking to call for the records relating to Cr. Nos.47 and 46 of 2014 respectively, both dated 03.09.2014, pending on the file of the first respondent police and quash the same. On the complaint lodged by Parvathy, the first respondent police registered a case in Cr. No.46 of 2014 under Sections 294(b) and 506(1) IPC on 03.09.2014 against Kanimozhi. On the complaint lodged by Kanimozhi, the first respondent police registered a case in Cr. No.47 of 2014 on 03.09.2014 under Sections 294(b) and 506(1) IPC. While so, Parvathy and Kanimozhi have filed these Criminal Original Petitions seeking quashment of the FIR filed against them on the complaint given by each other.
Today, Mr. Yogeswaran, S.S.I., C.4, Flower Bazaar Police Station is present and Parvathy and Kanimozhi are also present.
Today, Parvathy has filed an affidavit, wherein, she has stated as under:
"5 I submit that, I filed petition before this Hon'ble Court to quash the FIR and 2nd respondent also filed petition for quash FIR before this Hon'ble Court.
Now, I submit that both the parties compromised between themselves for which I filed affidavit before this Hon'ble Court."
Likewise, Kanimozhi also has filed an affidavit today, wherein, she has stated as under:
"5.
I respectfully submit that I have already attained my superannuation during 2014, I do not want to agitate the complaint given by me since I have entered into a compromise by not to proceed agains each other on the basis of the complaints given by us against each other."
In view of the compromise entered into by the petitioners, the prosecution in Cr. Nos.47 and 46 of 2014 on the file of the first respondent police are quashed on condition that the petitioners pay a sum of Rs.1,000/- each as costs to the credit of the Chief Justice Relief Fund (payable in Accounts Section of
the High Court Registry), within a period of two weeks from the date of receipt of a copy of this order and file a photocopy of the receipt along with a memo reporting compliance in the Registry.
In fine, these Criminal Original Petitions are allowed. Connected Crl.M.P. is closed.
