ORDER
The Criminal Original Petition is filed to quash the complaint pending investigation on the file of the Inspector of Police, CCB-I, Chennai.
2. Based on the complaint given by one Kesavan, a subscriber to the chit run by the family members of the petitioner, the respondent police have registered a case in Crime No.127 of 2022 for the alleged offence under Sections 406, 420, 506(i) of IPC and Section 76(1) of the Chit Funds Act, 1982.
3. The petitioner, though, claims that he has nothing to do with the alleged chit transaction; his name has been specifically mentioned in the complaint and the amount of the collected money has also been spoken in the complaint.
4. The learned Government Advocate (Crl.Side) submitted that 19 victims, who deposited their money with the accused persons have been cheated. So far, 15 victims have been examined. This petitioner 2/4
was summoned in the course of investigation and his recorded statement indicates that he has a role in collecting the chit subscription.
5. Since the investigation so far done, has disclosed the material to incriminate this petitioner, this petition to quash the complaint cannot be entertained. Hence, this Criminal Original Petition is dismissed with a liberty to the petitioner to workout his remedy after filing the final report 17.04.2024 Index:yes/no ari To:
