Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents to include the name of the petitioner in the appropriate place as per the TRB rank no.173 and accordingly consider the petitioner for promotion to the post of PG Assistant (Chemistry) in the School Education Department in any one of the available vacancies by allowing her to participate in the counselling scheduled on 27.05.2017 or on any other date. ORDER

This writ petition is filed for issue of a Writ of Mandamus directing the respondents to include the name of the petitioner in the appropriate place as per TRB Rank no.173 and accordingly, consider the petitioner for promotion to the post of PG

Assistant (Chemistry) in the School Education Department in any one of the available vacancies by allowing her to participate in the counselling scheduled to be held on 27.05.2017 or on any other date.

The petitioner, pursuant to her selection by the Teacher's Recruitment Board, was appointed as Junior Grade BT Assistant Teacher in Panchayat Union Middle School, 56, Vadapathi and thereafter, by proceedings of the 2nd respondent dated 25.09.2009 , the petitioner was transferred and appointed as BT Assistant (Chemistry) in Government Higher Secondary School, Perugavazhthan, Tiruvarur District. While so, the tentative list of candidates in the post of BT Assistants for promotion to the post of PG Assistants was published by the respondents and according to the petitioner, though she secured Rank No.173, her name was left out in the said list. Therefore, the petitioner submitted a representation to the 1st respondent on 06.04.2017. So far, the said representation has not been considered and she has also been not called for counselling. Aggrieved over the same, the petitioner has preferred this writ petition.

Learned counsel for the petitioner would submit that it would suffice, if the representation of the petitioner is directed to be disposed of, by the 1st respondent, before the scheduled date of counselling, ie., 27.05.2017. 4.

Considering the paucity of time, a direction is issued to the petitioner to submit a representation, with regard to the relief sought, before the Director of School Education/1st respondent herein, in person and the 1st respondent is directed to consider the same and pass orders, before the scheduled date of counselling, ie., 27.05.2017, deciding as to whether the petitioner is eligible to participate in the counselling. The writ petition is disposed of with the above directions. No costs. Connected W.M.P. is closed.
