This writ petition has been filed seeking issuance of a writ of mandamus directing the respondents 3 to 5 to consider the representation made by the petitioner on 27.09.2024 wherein the petitioner is seeking for correction of measurements in the patta as well as in the FMB sketch.
2. Heard Mr.K.Myilsamy, learned counsel for petitioner and Mr.A.Selvendran, learned Special Government Pleader appearing for respondents.
3. The case of the petitioner is that she was the owner of large extents of property. An extent of 1.98 acres was acquired by the Highways Department and the petitioner was left with the balance 97 cents. However, while making the sub-division and issuing the patta in Patta No.39, the extent was shown as 39.52 cents (16 ares). In view of the same, the petitioner made a representation to rectify the measurement both in the patta as well as in the FMB sketch. On receipt of the representation made by the petitioner, the Village Administrative Officer 2/4
also submitted a report and thereafter, there was no progress. It is under these circumstances, the present writ petition came to be filed before this Court.
4. Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the third respondent to deal with the representation made by the petitioner on 27.09.2024 on its own merits and in accordance with law and appropriate orders shall be passed within a period of eight (8) weeks from the date of receipt of a copy of this order. This writ petition is disposed of with the above direction. No costs.
