This petition has been filed to grant special leave to file appeal against the judgment of the learned Judicial Magistrate, Fastract Court, (Magisterial Level), Ambattur, Chennai in S.T.C.No.49 of 2016 dated 15.03.2021.

2. The petitioner is the complainant, filed a petition in S.T.C.No.49 of 2016 before the Judicial Magistrate, Fastract Court, (Magisterial Level), Ambattur, Chennai. After enquiry, the respondents/accused were acquitted. Challenging the same, the petitioner filed this appeal and since the appeal is against the acquittal, he filed the present petition to get a leave to file appeal.

3. Learned counsel for the petitioner would submit that after receiving the statutory notice, the respondents/accused admitted liability.

4. Heard the learned counsel for the petitioner.

5. On a perusal of records, the learned Magistrate failed to consider and dismissed the complaint. Hence, the petitioner seeks leave to file an appeal and that there is arguable points in this appeal. Therefore, this petition is allowed and leave is granted to the petitioner to file an Appeal before this Court as prayed for.
