ORDER

This Criminal Original Petition has been filed To permit the petitioner to defend the C.C.No.1532 of 2023 on the file of the Chief Judicial Magistrate Krishnagiri District.

2. Heard the learned counsel appearing for the petitioner the learned Government Advocate for the respondent and perused the materials available on record.

3. It is the case of the petitioner that the petitioner is working as a Manager of Total Environment Building Systems private Limited. For the irregularities committed by the petitioner company, the respondent filed a complaint before the learned Chief Judicial Magistrate, Krishnagiri District for the offence under Section 15(1) Rule 12(1) of the Industries Act.

4. The learned counsel for the petitioner submitted that the company has passed a resolution dated 01.08.2023 to authorize the petitioner to do all the day today affairs of the company. Hence, the learned counsel may permit the petitioner to defend the CC.No.1532 of 2023 on the file of the learned Chief Judicial Magistrate, Krishnagiri.

5. In the considered view of this Court, the relief that has been sought for before this Court must actually be sought for before the Court below. Liberty is granted to the petitioner to file an appropriate application before the Court below and the same shall be considered on its own merits and in accordance with law. The Court below shall take this stand into consideration and complete the proceedings as expeditiously as possible.
