C.M.P.No.7620 of 2023 in C.M.A.SR.No.37220 of 2023 N.MALA.J., This Petition has been filed to condone the delay of 1433 days in filing the above C.M.A.SR.No.37220 of 2023.
2.Though notice was served to the first respondent, none appeared before this Court.
3.Mr.R.Sivakumar, learned counsel appears for second respondent.
4.I have gone through the affidavit filed in support of the petition and I am satisfied with the reasons stated therein, therefore, the delay of 1433 days is condoned on condition that the petitioner forefeits interest for the delay period of 1433 days.
5. Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and post the same for admission.
Registry is further directed to print the name of the second respondent counsel at the time of admission.
Accordingly, this CMP is ordered.
