The first defendant had filed his written statement and it is seen that there is a delay of 2020 days in filing the written statement. Accordingly, he has taken out A.No. 6141 of 2016 to condone the delay in filing the written statement and to express his bona fide filed the written statement also. 2.

It is seen that the first defendant is Canara Bank and it also sought that the first defendant has raised arguable issues in the written statement. The defendant is a necessary party since the issue relates to documents which are alleged to be fake and not scrutinized properly. To settle their particular issue, the first defendant is a necessary party to the suit. 3.
