Respondent PRAYER: Criminal Revision Case has been filed under Sections 438 and 442 of BNSS, praying to set aside the dismissal order passed by the District Munsif cum Judicial Magistrate at Cheyyur in Crl.MP.No.87 of 2025 dated 03.03.2025 and further directing the learned District Munsif cum Judicial Magistrate at Cheyyur, to return the petitioner's four-wheeler bearing Reg.No.PY01CM 9191 Maruti Claz SHVS ZDI BS IV to the petitioner. ORDER

This criminal revision case has been filed praying to set aside the order passed by the District Munsif cum Judicial Magistrate at Cheyyur in Crl.MP.No.87 of 2025 dated 03.03.2025.

The petitioner owns the four-wheeler bearing Reg.No.PY01CM 9191 Maruti Claz SHVS ZDI BS IV. He illegally transported liquor from Pondicherry. Therefore, the respondent registered FIR in crime No.43 of 2025 for the offence punishable under Section 4(1)(A) of TNP Act r/w Section 4(1)(aaa), 4(1-A)(ii) of TNP Act. Thereafter, the vehicle and the liquor were seized and produced before the Magistrate court concerned, pursuant to which the petitioner filed a petition to return the aforementioned vehicle. However, the said petition was dismissed, against which this criminal revision case has been filed.

The learned counsel for the petitioner would submit that so far, no confiscation order has been passed.

In this regard, the learned Government Advocate(crl.side) appearing for the respondent submitted that confiscation proceedings in respect of the vehicle which was used in the crime, is now under progress and order is

yet to be passed.
