PRAYER: This Criminal Original Petition filed under Section 482 of Cr.P.C., to direct the respondent to register the case on the complaint dated 17.01.2022 and file the FIR.

O R D E R

This Criminal Original Petition has been filed to direct the respondent to register the case on the complaint dated 17.01.2022 and file the FIR.

2. Learned counsel for the petitioner would submit that while the petitioner is in his hotel on 15.12.2022, the second wife of the petitioner along with her henchmen had assaulted the petitioner with iron rod and wooden logs, due to which, the petitioner had sustained injuries. He got treatment in Hospital. Once again the second wife of the petitioner along with her henchmen had assaulted the petitioner by pouring hot cooking oil on the petitioner's chest. He would submit that the petitioner was admitted in the hospital and discharged on the next day. The petitioner had given a complaint to the respondent. However, no action has been taken by the respondent. Thereby, the present petition has been filed seeking direction to the respondent to register the case on the petitioner's complaint.

3. Mr.A.Gokulakrishnan, learned Additional Public Prosecutor would submit that the petitioner was earlier admitted in https://hcservices.ecourts.gov.in/hcservices/

Jolarpet Government Hospital and on instruction from the hospital, Officer from the Jolarpet Police Station has visited the hospital and enquired the petitioner. During the enquiry, the investigating officer came to know that the petitioner has sustained burn injuries by pouring hot water by himself, based on which, the enquiry has been closed. Subsequently, taking the advantage of the injuries, the petitioner had given a false complaint to the respondent. Thereby, the respondent has closed the enquiry.

4. At this juncture, learned counsel for the petitioner would submit that the petitioner has not received the closure report.

5. In view of the above, direction is issued to the respondent to furnish the copy of the closure report to the petitioner within a period of two weeks from the date of receipt of a copy of this order. On such receipt, the petitioner is at liberty to challenge the closure report by way of filing protest petition in accordance with law.

6. With the above direction, this Criminal Original Petition stands disposed of.
