O R D E R

This Transfer Civil Miscellaneous Petition has been filed seeking transfer of F.C.O.P.No.70 of 2019 from the file of the Family Court, Vellore and transfer the same to the file of Sub Court, Poonamallee.

2. The respondent and petitioner are husband and wife. The respondent/husband filed a petition for divorce in FCOP.No.70 of 2019 before Family Court, Vellore. The child is aged about 6 years and she is suffering from pneumonitis and underwent surgery and advised rest by the Doctors. In such circumstances, it is very difficult for the petitioner/wife to travel to Vellore for every hearing. Hence, she seeks transfer.

3. Despite service of notice, the respondent has not chosen to appear before this Court.

4. Considering the medical condition of the child, aged 6 years as well as the physical hardship caused to the petitioner/wife, this Court is inclined to allow the petition.

5. Accordingly, H.M.O.P.No.70 of 2019 pending on the file of Family Court, Vellore is withdrawn and transferred to the file of Sub Court, Poonamallee.

6. The Transfer Civil Miscellaneous Petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is closed.
