O R D E R

(The case has been heard through video conference) The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 4(1) (aaa) & 24 of the Tamil Nadu Prohibition Act 1930 in Crime No.272 of 2020 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that on 05.04.2020, one Sridhar was found in possession of 42 bottles of liquor. On enquiry it was found that the petitioner who is the Supervisor of a TASMAC shop has given the bottles to him for selling them in higher prices. Hence, the complaint.

3. The learned Counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case based on confession of co-accused. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that there are totally three accused in this case and the petitioner is arrayed as A1. The petitioner who is the Supervisor of a TASMAC shop has took the liquor bottles from the shop and given them to the other accused persons to sell them for higher prices and that 864 liquor bottles have been recovered from the accused. He further submitted that the petitioner has already been convicted in three previous cases. Hence, he vehemently opposed for the grant of anticipatory bail to the petitioner.

5. Taking into account that the petitioner has already been convicted in three other cases, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
