ORDER

The petitioner, who was arrested and remanded to judicial custody on 11.01.2026 for the alleged offences punishable under Sections 87 of BNS read with Section 9(n), 10, 18 of Protection of Children sexual offences Act, 2012 in Crime No.04 of 2026 on the file of the respondent police, seek bail.

2. The case of the prosecution is that the petitioner is studying 10th std and she is the relative of the petitioner and on the date of occurrence, petitioner took the victim girl into the secluded place and committed penetrative sexual assault. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and due to previous enmity between the two family members and using the victim as as trump card, false complaint was lodged. He further submitted that the petitioner was arrested on 11.01.2026 and since then he has been in judicial custody. Hence, he prays to grant bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent strongly opposed the bail application and would contend that it is a clear case of sexual assault against the victim. He also produced the statement of the victim under Section 183 of BNSS recorded before the learned Magistrate, wherein she had categorically stated about the sufferings and the injuries suffered by her in this case.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. Considering the gravity of the offence committed by the petitioner against the victim girl, at this stage, if the petitioner is enlarged on bail, it would cause trauma in the minds of the victim girl and hence, this Court is not inclined to grant bail to the petitioner.
