C.M.P.No.7050 of 2022 C.M.P.No.7050 of 2022 in A.S.(SR).No.13256 of 2018 C.V.KARTHIKEYAN, J.

The application has been filed seeking to condone the delay of 725 days in representing A.S.SR.No.13256 of 2018. 2.The said Appeal Suit arises from a suit for partition. 3.The appellant is the defendant in the suit. 4.Partition had been granted and preliminary decree had been passed. Appeal had been filed in the year 2018 and it had been returned by the registry for compliances.

5.In the affidavit filed in support of the application, it had been stated that the papers had been returned by the registry had been misplaced and mixed with other bundles in the office of the advocate. Thereafter, owing to Covid-19 pandemic situation, there was a delay in representing the appeal.

6.In view of the reasons stated, the delay is condoned. 7.Registry is directed to number the A.S.SR.No.l3256 of 2018, if it is otherwise in order.
