ORDER

The petitioner/defacto complainant had lodged a complaint and the case in Crime No.58 of 2024 for offence under Sections 420, 120B and 34 of IPC

has been registered. On conclusion of investigation, a charge sheet has been filed and the same was taken in C.C.No.119 of 2025 on the file of the Additional Court for Exclusive Trial for CCB Cases, Egmore.

2. The grievance of the petitioner is that the petitioner had name, one Murugan in the FIR and he was arrayed as A1 in the said FIR. However, in the charge sheet the name of the said Murugan has been deleted without any notice to the petitioner, and the petitioner was not informed about the same.

3. Learned Government Advocate (Criminal Side) fairly submits that the deletion of the Murugan's name in the charge sheet had not been informed to the petitioner and no notice has been served.

4. In view of the above, the petitioner is permitted to approach the trial court by filing a protest petition. On filing of such a petition, the trial court shall consider and pass orders on merits.
