ORDER

(The case has been heard through video conference) This Criminal Original Petition has been filed seeking a direction to direct the respondent police to not to harass the petitioners 1 & 2 in connection with Crime No.232 of 2020 on the file of the respondent police under the guise of enquiry / investigation.

2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent police.

3.The learned counsel for the petitioners would submit that the respondent police harassed the 1st petitioner under the guise of enquiry. He would further submit that the 2nd petitioner being the son of the 1st petitioner / defacto complainant is also called for enquiry by the respondent police and the respondent police threatened the 2nd petitioner to withdraw the complaint. https://hcservices.ecourts.gov.in/hcservices/

4.The learned Additional Public Prosecutor appearing for the respondent police submitted that pursuant to the correction in Crime No.232 of 2020, where the 1st petitioner is the defacto complainant, a case has been registered for the offences under Sections 147, 294(b), 448, 427, 323, 506(i) IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002 and Section 3(1)(r), 3(1)(s), 3(1)(w)(1), 3(2) (II), 3(2)(va) of SC / ST (Prevention of Atrocities) Act, 1989. Hence the petitioners are called for investigation.

5.Considering the above facts and circumstance of the case, this Court directs the respondent police to complete the investigation in accordance with law in Crime No.232 of 2020 pending on his file and file a final report before the concerned Court within a period of twelve weeks from the date of the receipt of a copy of this Order.

6.This Criminal Original Petition is disposed of accordingly.
