O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 4(1)(aaa), 4(1-A) of Tamil Nadu Prohibition Act r/w 6 and 11 of R.S. Rules 2000 in Crime No.819 of 2020 on the file of the respondent police, seeks anticipatory bail. 1/3

2. The case of the prosecution is that the petitioner herein and two other accused was illegally transporting 420 litres of ID Arrack in a Xylo car. Hence the case has been registered against the petitioner.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he did not commit any offence as alleged by the prosecution. The learned counsel further submitted that the respondent police has registered the case against the petitioner for statistical purpose. The learned counsel submitted that the co-accused persons were arrested and released on bail by the lower Court. Hence, he sought for grant of anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that the petitioner has involved in the offence of illicit transport of rectified spirit and the petitioner has one previous case. Hence, he vehemently opposed for the grant of anticipatory bail to the petitioner.

5. Taking into account, the antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
