Writ petition filed under Article 226 of the Constitution of India to issue a Writ of mandamus, to direct the 1st respondent to call for records from the respondents 2 and 4 in connection with the application submitted by the petitioner
school vide letter dated 06.09.2017 for grant of theory examination centre for class X at the petitioner's school and grant permission for the same within a stipulated time. For Petitioner : Mr.T.P.Prabakaran For Respondents : Mr.T.M.Pappiah, Special Government Pleader
ORDER
The petitioner school was started in the year 1990 and it is a co-education Higher Secondary School. From the year 2007 onwards, practical examination is being conducted in the petitioner school with the permission of the concerned authorities. The petitioner school has sent a representation to the respondents seeking permission to make the school as a centre for both 10th standard examination as well as 12th standard examination theory paper from the year 2011 onwards. The 5th respondent District Educational officer has also recommended to the Chief Educational Officer to make or to notify the petitioner school as a centre for conducting 10th standard examination. However, so far no action has been taken. Hence the petitioner has come before this Court.
2.Heard Mr.T.P.Prabakaran, learned counsel appearing for the petitioner. He would submit that the school has been in existence from the year 1990 onwards. Practical examination for the 12th standard students is being conducted from the year 2007 onwards, as the school has got infrastructure for conducting the examination. In fact, the 5th respondent has also recommended to the Chief Educational Officer to notify the petitioner school as a centre for 10th standard examination.
Therefore, the petitioner school has to be notified as a centre for 10th standard theory examination.
3.Mr.T.M.Pappiah, learned Special Government Pleader would submit that the petitioner gave representation on 06.09.2017 along with certificates in the appropriate format and the said representation would be considered by the respondents. 4.Taking into consideration the credentials of the petitioner school and 109 boy students and 107 girl students from the petitioner school are writing the 10th standard examination, it is appropriate to direct the respondents, especially, the 2nd respondent to take a decision on the petitioner's representation dated 06.09.2017, as per law and on its own merits within a period of two weeks from the date of
receipt of a copy of this order.
With the above direction, this Writ Petition is disposed of. No costs.
