ORDER

Seeking a direction to the 1st respondent to register the case on the petitioner's complaint dated 19.03.2015, the petitioner has come up with this petition.

2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent and perused the material placed on record.

3.The learned Additional Public Prosecutor submitted that the said complaint of the petitioner was enquired and closed by the respondent police on 26.04.2015 and also submitted that a copy of the closure report is furnished to the learned counsel for the petitioner across the bar.

4.The learned Additional Public Prosecutor submitted that the petitioner was in occupation of the Shop and he had entered into a compromise with the complainant on 28.06.2010 to vacate the shop but, he has not handed over the same. Thereafter, the petitioner has lodged the present complaint. The learned Additional Public Prosecutor further submitted that the said agreement was never acted upon.

5.The learned Additional Public Prosecutor submitted that the summons issued to the petitioner, but he did not appear before the police and therefore, the petition enquiry was closed based on the documents submitted by the opposite party. In view of the above, this petition is closed with liberty to the petitioner to work out his remedies in the manner known to law.
