In W.P.(IPD)No.13 of 2025, the petitioner had filed Trade Mark Application No.1529769 in Class 36. The 2nd respondent filed Opposition No.831894 in respect of the said application. In W.P.(IPD)No.14 of 2025, the petitioner filed Trade Mark Application No. 1767002 in Class 36. The 2nd respondent therein filed Opposition No.773722 in respect thereof. By these writ petitions, the petitioner seeks expeditious disposal of the Opposition and corresponding applications.
2. Mr.Ramesh Ganapathy, learned counsel, appears on behalf of the 2nd respondent in the said writ petitions. He has filed a reply on behalf of the 2nd respondent in both the writ petitions. In such reply, without prejudice to the grounds of opposition, it is stated that the 2nd respondent has no objection to the expeditious disposal of proceedings.
3. The record shows that the notice of opposition was filed in July 2015. The applications appear to have been filed much prior thereto. These 3/6
facts and circumstances justify a direction for the expeditious disposal of proceedings.
4. Accordingly, without making any observation on the merits of the respective applications or oppositions, these writ petitions are disposed of with the following directions:
(i) The Registrar of Trade Marks is directed to dispose of Opposition No.831894 and connected Trade Mark Application No.1529769 in Class 36 within three months from the date of receipt of a copy of this order. (ii) The Registrar of Trade Marks is directed to dispose of Opposition No.773722 and connected Trade Mark Application No.1767002 in Class 36 within three months from the date of receipt of a copy of this order. (iii) There will be no order as to costs.
