The matter is listed today under the caption "for being mentioned" at the instance of the learned counsel for the petitioners.

2. Learned counsel for the petitioners submitted that this Court vide order dated 24.03.2026, directed the 1st respondent to conclude the proceedings as the revision pending before the 1st respondent, whereas in the operative portion viz., para 7 it has been wrongly mentioned as the third respondent. Hence, she prayed for necessary correction in the above regard.

3. Learned Government Advocate appearing for the official respondents has stated no objection for the above correction.

4. Inadvertently, due to a typographical error, it has been mentioned as the third respondent and the same stands corrected as the first respondent. Accordingly, para 7 of the said order shall stand substituted with the following :-

Considering the facts and circumstances of the case, this Court without going into the merits of the case directs the first respondent to conclude the proceedings dated 03.06.2025 after giving notice and opportunity of hearing to the petitioners as well as the private respondents within a period of six weeks from the date

of receipt of a copy of this Order.

5. Except the aforesaid modification, remaining portion of the order dated 24.03.2026 remain unaltered.

6. Registry is directed to carry out aforesaid corrections and issue fresh order copy to the parties.

ORDER

WMP.No.11438 of 2026 has been filed to permit the petitioners to file a single writ petition. This petition is ordered on payment of single court fee.

2. This petition has been filed challenging the Legal Heir Certificate issued by the third respondent in favour of the private respondents.

3. By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself. Since no adverse order is passed against the private respondents, notice to the private respondents is dispensed with.

4. It is the case of the petitioners that the petitioners are the first wife's children of the deceased Imthiaz Rahim Lukman. Due to the matrimonial dispute, their parents got separated in the year 2005, thereafter, their father got married to the fourth respondent and the respondents 5 to 8 are their children. Their father died on 26.10.2021 and it is the grievance of the petitioners that the private respondents have obtained legal heir certificate excluding the petitioners. The petitioners have made a representation to the second respondent for cancelling the legal heir certificate, the second respondent forwarded the file to the third respondent, however, no action has been taken. The petitioners have filed a revision before the first respondent and the same is pending for consideration. Challenging the legal heir certificate, the present petition.

5. The learned counsel for the petitioner seeks for a direction to conclude the proceedings of the third respondent dated 03.06.2025 within a reasonable time as fixed by this Court.

6. Heard the learned counsel for the petitioner and the learned Government Advocate and perused the materials placed on record.

7. Considering the facts and circumstances of the case, this Court without going into the merits of the case directs the third respondent to conclude the proceedings dated 03.06.2025 after giving notice and opportunity of hearing to

the petitioner as well as the private respondents within a period of six weeks from the date of receipt of a copy of this Order.
