ORDER
This writ petition has been filed for the issue of a writ of mandamus directing the 1st respondent to consider the representation made by the petitioners on 10.02.2021, wherein the petitioners have sought for incorporating their names as owners of the property in the revenue records. 2.Heard Mr.M.Anandha Kumar, learned counsel for the petitioners and Mr.M.R.Gokulkrishnan, learned Additional Government Pleader for respondents 1 and 2.
3.The case of the petitioners is that the subject property was proceeded under the Tamil Nadu Urban Land (Ceiling and Regulation) Act. The petitioners were deriving their title of the property from one Thandavamurthy. The said Thandavamurthy filed WP.No.19869 of 2005, challenging the ULC proceedings. This Court by an order dated 06.11.2012, allowed the writ petition and the ULC proceedings stood quashed. 4.Since the petitioners are deriving their title from the said Thandavamurthy, they made a representation to the 1st respondent on 10.02.2021 to incorporate their names as the owners of the subject property in the revenue records. Since the same was not considered, the present writ petition has been filed before this Court. 2 / 4
5.The learned Additional Government Pleader appearing on behalf of the respondents submitted that the change in the revenue records can be effected and the patta can be issued in the name of the petitioners only after the necessary Government order is issued. Therefore, the learned Additional Government Pleader sought for sometime in this regard.
6.Taking into consideration the facts and circumstances of the case and considering the fact that the ULC proceedings itself has come to an end by virtue of the order passed by this Court in WP.No.19869 of 2005, dated 06.11.2012, which order has become final, there shall be a direction to the 1st respondent to follow-up with the concerned authority and get the necessary Government order passed in order to restore the lands in the name of the petitioners and to grant patta in the name of the petitioners.
