Respondents Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of Mandamus, directing the first respondent to release the vehicle TATA Mini Lorry bearing Registration No.TN-10-AC-1517 to the petitioner pursuant to the representation dated 25.05.2015.

ORDER

Writ petition has been filed praying for the issuance of a writ of Mandamus, directing the first respondent to release the vehicle TATA Mini Lorry bearing Registration No.TN-10-AC-1517 to the petitioner pursuant to the representation dated 25.05.2015.

2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents.

3.When the matter is taken up for admission, it is brought to the notice of this Court by the learned Government Advocate that confiscation proceedings have been initiated on 05.05.2015 in Proceedings No.873/2013/S3. Even in the confiscation order, it is stated that appeal is provided before the District and Sessions Judge under Section (6)(C) of Essential Commodities Act. Therefore, this writ petition is not maintainable.
