O R D E R

This Criminal Original Petition is filed praying to withdraw and transfer the case in S.C.No.178 of 2007 on the file of Principal Assistant Sessions Court, Kumbakonam to Court of Sessions at Nagapattinam.

Heard learned Additional Public Prosecutor appearing on behalf of the respondent and there is no representation for the petitioner.

By way of this Criminal Original Petition, seek transfer of S.C.No.178 of 2007 on the file of Principal Assistant Sessions Court, Kumbakonam to Court of Sessions at Nagapattinam, where the petitioner complaint case is pending adjudication. This Court finds there being no proof of the petitioner's complaint pending adjudication before the Court to which transfer is sought. This petition shall stand dismissed.

4. Considering the fact that owing to the pendency of this Criminal Original Petition over the period of 9 long years. No progress whatsoever has made in S.C.No.178 of 2007. This Court directs the trial Court to deal with the case expediously and dispose of the same without fail within a period of 3 months from the date of receipt of this order.

5. The prosecution is required to make all out efforts to produce witnesses before the Court below on the date fixed for hearing and the Court below is required not to permit unnecessary adjournments at the request of either prosecution or defence.

6. With the above directions, this Criminal Original Petition stands dismissed.
