ORDER
The petitioner has preferred the present Criminal Revision challenging the judgment passed by the learned Judicial Magistrate, Annur in Crl.MP.No.1424 of 2024 in C.C. No.405 of 2023 dated 08.08.2025.
2. The case of the prosecution is that the defacto complainant, a whole sale rice dealer, supplied rice bags to the accused on credit, who agreed to pay the amount within 30 days. However, after making part payment, the accused failed to pay the balance and thereby cheated the defacto complainant. Hence, the case has been registered.
3. The learned counsel for the petitioner submitted that during the course of investigation, no cheques were recovered and there was no reference to the original cheques. However, at the stage of trial, the said original cheques were marked, which is impermissible, and therefore, the same has caused prejudice to the petitioner.
4. Per contra, the learned Government Advocate (Crl.Side) submitted that the said cheques are material documents. He further submitted that, while examining P.W.1, the documents were not marked due to inadvertence, and the same have now been rightly marked by the trial Court and that no prejudice would be caused to the petitioner on account of the same.
5. I have given my anxious consideration to the submissions made on either side.

In this case, the learned Magistrate, on considering the submissions made on either side, has rightly come to the conclusion that the seven cheques are necessary and relevant for the proper adjudication of the case. He has also been rightly observed that the marking of such documents would not cause any
prejudice to the petitioner. Therefore, this Court is of the firm view that there are no grounds made out to interfere with the order of the learned Magistrate. Accordingly, this Criminal Revision Petition stands dismissed. 24-03-2026 DRL To
