This petition is filed to condone the delay of 86 days in filing the appeal.

Heard Mr.M.B.Raghavan, learned counsel for the petitioner.

It is submitted by the learned counsel for the petitioner that the fifth respondent is not a necessary party or a contesting party, against whom, no relief has been sought. Therefore, he seeks to give up the fifth respondent.

The same has been recorded and the fifth respondent is therefore removed from the array of parties.

Respondents 1 to 4 and 6, having been served, none appears before this Court, except Mr.S.P.Chockalingam, learned counsel, who appears for respondent 7.

The delay is 86 days. Having been satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 86 days in filing the appeal is condoned.

Accordingly, the petition stands ordered.
