PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C. Praying, to order withdrawal of M.C.No.45 of 2018 now pending on the file of the learned VII Additional Family Judge Chennai and transfer the same to some other learned Principal Family Judge, Chennai.

O R D E R

This Criminal Original Petition has been filed to transfer of M.C.No.45 of 2018 from the file of the learned VII Additional Family Judge Chennai to the learned Principal Family Judge, Chennai.

2. The learned counsel for the respondent would submit that the respondent filed maintenance case in M.C.No.45 of 2018, which is pending on the file of the learned VII Additional Family Court. Thereafter, the respondent/petitioner's wife also filed a divorce petition in H.M.O.P.No.2184 of 2018 as against the petitioner and it is pending on the file of the IV Additional Family Court, Chennai.

3. Considering the facts and circumstance of the case and submission made by the learned counsel for the respondent, this Court is inclined and would like to allow this petition and thereby M.C.No.45 of 2018 is hereby withdrawn from the file of the VII Additional Family Court and the same is transferred to the IV Additional Family Court, Chennai.
