(Order of the Court was made by C.V.Karthikeyan, J.) This petition has been filed to condone the delay of 175 days in filing the appeal against the judgment and decree in HMOP No.524 of 2022 by the Family Judge at Salem, dated 29.08.2025. 2.The appellant herein was the petitioner before the Family Court and had filed a petition seeking divorce on the ground of cruelty and desertion. That petition was dismissed. Notice had been directed in this petition. Respondent had been served, but however, there is no appearance on behalf of the respondent. The name of the counsel is also printed in the cause list.

3.In the affidavit filed in support of the petition, it had been stated that due to health condition of the parents and to arrange school fees for the children, the petitioner was facing financial crisis and not able to mobilize the amount for filing the appeal. In the said process, there has been a delay.

4.Taking all the factors into consideration, the delay stands condoned and the petition is ordered. Registry to number the Appeal, if it is otherwise in order and list the appeal for admission. Registry may also print the name of the counsel for the respondent in the cause list when the appeal is posted for admission.
