ORDER

This Criminal Revision Petition has been filed to set aside the order passed in Crl.M.P.No.747 of 2026 on the file of the learned XXIII Metropolitan Magistrate, Saidapet, Chennai, dated 24.02.2026, relating to the return of the case.

2. The learned counsel for the petitioner submitted that he had paid a sum of Rs.42,00,000/- to the accused in order to secure a college seat. It is further submitted that the accused has deposited a sum of Rs.7,00,000/- in pursuance of the order passed in Crl.M.P.No.289 of 2026 dated 24.02.2026. Therefore, the petitioner prayed for release of the said amount.

3. The learned Government Advocate (Crl. Side) strongly opposed the application on the ground that the said amount was not recovered by the police and that it was deposited by the petitioner pursuant to the condition imposed in the bail order.

4. As rightly observed by the learned Judicial Magistrate, unless the case is finally disposed of, the question of disbursal of the amount does not arise, since the amount was deposited as a condition for bail. Hence, this Court finds no infirmity in the order passed by the learned Magistrate. Accordingly, this Criminal Revision Petition is dismissed. 17-03-2026 MPA To
