ORDER
The petitioners, who were arrested and remanded to judicial custody on 25.02.2026 for the alleged offences under Sections 123 of B.N.S. read with Section 24(1) of COTPA in Cr. No.48 of 2026 on the file of the respondent police, seek bail.
2. The case of the prosecution is that the petitioners were found in illegal possession of 500 kgs of Hans products. Hence the case.
3. The learned counsel for the petitioners would submit that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. He would further submit that false case has been registered against these petitioners and they are ready and willing to abide by any condition that may be imposed by this Court and hence prayed for grant of bail to the petitioners.
4. The learned Government Advocate (Criminal side) appearing for the respondent police reiterated the prosecution case and strongly objected to enlarge the petitioners on bail on the grounds huge quantity is involved in this case and investigation is at preliminary stage.
5. From the submissions made by the learned Government Advocate, it appears that this is the case where huge quantity i.e., 500 kgs of Tobacco products were secured from the accused and the investigation is at preliminary stage. Therefore, upon considering the submission of the learned Government Advocate that the investigation is at preliminary stage, and that the petitioners have been under incarceration only since 25.02.2026, this Court is not inclined to enlarge the petitioners on bail at this stage.
6. Accordingly, this Criminal Original Petition is dismissed. 11-03-2026 MJS Note:
