The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 24(1) of the Cigarette and other Tobacco Products Act, 2003 r/w Section 328 of IPC in Crime No.115 of 2023, seeks anticipatory bail.

2. The case of the prosecution is that on 01.03.2023 at about 9.00 p.m, during the regular patrol, the respondent police found that the petitioner along with other accused were found in possession of huge quantities of Hans, Cool Lip, Vimal, VI, RMD banned Tobacco products for sale worth Rs.16,17,000/-. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.

4. Per contra, the learned Government Advocate (Criminal Side) would submit that the petitioner is a habitual offender and that the petitioner along with other accused were found in possession of banned tobacco products. He would further submit that A1 has been arrested and released on bail. Hence, he vehemently opposed for the grant of anticipatory bail to the petitioner.

5. Taking into account the nature of offence and the previous antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
