Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of certiorarified mandamus, calling for the records of the District Registrar, "Thiruvannamalai, the 2nd respondent herein culminating in proceedings No.3640/B1/2016 dated 22.12.2016 and quash the same and further direct the 3rd respondent Sub Registrar, Thiruvannamalai to cancel the settlement deeds Doc.Nos.5233/2011, 5244/2011, 5234, 5235 and 5245 and 5303/2011 registered on 18.05.2011, 19.05.2011, 23.05.2011 and 01.06.2011 respectively in the 3rd respondent office.

ORDER

Mr.S.N.Parthasarath, learned Government Advocate, takes notice for the respondents 1 to 3.

2. Mr.P.Wilson, learned Senior Counsel appearing for the petitioner sought the permission of this court to withdraw the writ petition with liberty to file an appeal as against the impugned order passed by the 2nd respondent . The learned counsel on record has also made an endorsement to that effect.

3. In view of the same, the writ petition stands dismissed as withdrawn. It is open to the petitioner to challenge the impugned order dated 22.12.2016 before the 1st respondent in accordance with law. In the event of the 1st respondent entertaining the appeal to be filed by the petitioner, the petitioner is at liberty to raise all the issues before the 1st respondent. No costs. Consequently, connected miscellaneous petition is closed.
