Crl.M.P. No. 339 of 2024 in Crl.RC.No. 875 of 2019 R. KALAIMATHI, J.

The Superintendent of Police, Economic Offences Wing, Chennai has filed this application to direct the learned Special Judge for TNPID Cases, Chennai to accept the Additional Final Report in C.C.No. 04 of 2017 stating that due to Covid-19 pandemic situation Investigating Agency was not in a position to file an Additional Final report within a stipulated time.

2. Originally, one of the accused namely M. Gnanaprakasam filed Crl.R.C.No. 875 of 2019 under Section 397 r/w 401 of Criminal Procedure Code to set aside the order dated 08.04.2019 passed by the Learned Special Judge under TNPID Act cases, Chennai in Crl.M.P.No. 1301 of 2018 in C.C.No. 4 of 2017. Wherein this Court by an order dated 30.08.2019 directed the petitioner to complete further investigation within a period of six months from the date of receipt of a copy of this order. Thereafter, by an order dated 18.03.2021 extension of three months time was granted in Crl.M.P.No. 3540 of 2021. It appears that the supplementary report was filed before the Special Court on 06.10.2022.

3. Learned Advocate appearing for the respondent has no serious objection. In such facts and circumstances, the delay of 58 days is condoned and Special Judge for TANPID cases, Chennai is directed to accept the supplementary report filed in C.C.No. 04 of 2017.

4. With the aforesaid observations, this Crl.M.P.No. 339 of 2024 is ordered accordingly.
