Mr.P.Dhileepan, Government Advocate (Crl.Side) COMMON ORDER These Criminal Miscellaneous Petitions have been filed to suspend the sentence imposed on the petitioner and to exempt him from surrendering pursuant to the judgment dated 12.01.2026 passed in Crl.A.No.16 of 2025 on the file of the learned Principal District and Sessions Judge, Thiruvarur, confirming the judgment dated 24.02.2025 passed in C.C.No.17 of 2024 on the file of the learned District Munsif cum Judicial Magistrate, Valangaiman, pending disposal of the above criminal revision, and to enlarge the petitioner on bail.
2. The petitioner has been convicted and sentenced by the learned Trial Judge as follows:- 2/4
Conviction under Section Sentence awarded 309(4) of BNS To undergo 3 years RI and to pay a fine of Rs.2,000/- (id) to undergo 1 month SI.
3. Aggrieved by the same, the petitioner filed a Criminal Appeal in Crl.A.No.16 of 2025, and the same was dismissed by the learned Principal District and Sessions Judge, Thiruvarur, confirming the judgment dated 24.02.2025 passed in C.C.No.17 of 2024. Aggrieved by the same, the petitioner has filed Crl.R.C.No.643 of 2026 before this Court along with the instant criminal miscellaneous petitions seeking suspension of sentence and exemption from surrendering before the Trial Court.

The case of the prosecution is that on 26.09.2024 at about 13.30 hours, when the de facto complainant, Selvamani, was working in the kitchen at the backyard of his house, the accused, Anbarasan, asked him for drinking water. When the de facto complainant brought water, the accused threw chilli powder on his face and snatched a gold chain weighing about 15 grams from his neck. Hence, the case.
4. The learned counsel for petitioner would submit that she has raised substantial grounds in this revision.

5. I have given anxious consideration to the submissions made by the learned counsel on either side and also perused the records available.
6. Considering the nature of allegations levelled against the petitioner and the concurrent findings of the two Courts, which discloses the serious nature of the offence, the question of granting suspension of sentence and exempting the petitioner from surrendering before the Trial Court is to be rejected.
