ORDER

This Criminal Original Petition has been filed praying, to direct the learned Chief Judicial Magistrate, Erode to recall the non-bailable warrant without insisting the presence of the petitioner/2nd accused in C.C.No.594 of 2013 on the file of Chief Judicial Magistrate Court, Erode.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3. It is submitted by the learned Additional Public Prosecutor that fourteen witnesses have been examined in this case and since the petitioner did not appear, Non-Bailable Warrant is pending from 30.03.2015.

4. Therefore, this Court cannot accede to the request of the petitioner. The petitioner is directed to surrender before the Trial Court and file an application for recall of Non-Bailable Warrant.
