(CR.NO.160/2021) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition imposed to the petitioner as that the petitioner shall appear before any police station in Chennai instead of appear before the Inspector of police Orleanpet, Police station, Puducherry, daily at 10.30 a.m. until further orders in Crl.MP.NO.2261 of 2022 in Crl.OP.No.2506 of 2022 by order dated 28.02.2022 on the file of this Hon'ble court and thus render justice.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.D.PRASANNA KUMAR, Advocate for the petitioner and of MR. V.BALAMURUGANE, Public Prosecutor for Puducherry on behalf of the Respondent the court made the following order:- The present petition has been filed to modify the condition that the petitioner shall appear before any police station in Chennai instead of appear before the Inspector of Police, Orleanpet Police Station, Puducherry, daily at 10.30 a.m., until further orders in Crl.M.P.No.2261 of 2022 in Crl.O.P.No.2506 of 2022 dated 28.02.2022

2. The learned counsel for the petitioners submitted that the petitioners are innocent and they have been falsely implicated in this case. He further submitted that the petitioner unable to appear before the respondent police due to his personal life threat in said locality, the petitioner is ready to appear any police station in

Chennai and the investigation has been completed and the charge sheet has also been filed in PRC.No.01 of 2022 before the learned Judicial Magistrate-II, Karaikal Hence, the present modification petition has been filed before this Court.

3. The learned Government Advocate (Crl.Side) submits that the petitioner has not complying with the conditions imposed by this Court in Crl.M.P.No.2261 of 2022 dated 28.02.2022.

4. Considering the facts and circumstances of the case and also the fact that the petitioner has not complied with the order dated 28.02.2022, this Court is not inclined to modify the conditions imposed by this Court.

5. Accordingly, this Criminal Miscellaneous Petition is dismissed and the petitioner is directed to comply with the order dated 28.02.2022 in Crl.M.P.No.2261 of 2022 imposed by this Court. -sd/- 16/06/2022 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
