ORDER

The petitioner apprehends arrest for the alleged offence under Sections 318(4) r/w 3(5) of BNS in Crime No.187 of 2025 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that the petitioner has deceived 24 victims by receiving Rs.3 lakhs as to get job in abroad. Hence, this complaint.

3. The learned counsel for the petitioner submitted that the petitioner was innocent and that he has been falsely implicated in this case. He further submitted that he is ready to abide by any stringent condition that may be imposed by this Court and he is ready to co-operate for investigation. Hence, he prays to grant anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that Rs.71 lakhs has been deposited in the petitioner's Bank account, Rs. 11 lakhs to the petitioner's wife bank account, Rs.7 lakhs 20 thousand has been deposited in the petitioner's mother-in-law account and Rs.5 lakhs has been deposited in his brother-in-law account. The specific submission of the learned Special Public Prosecutor is that unless the petitioner is taken custody, the layering of the money could not be identified and the recovery will become very difficult. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given my anxious consideration to the submissions made by the learned counsel on either side and perused the materials available on record.

Considering the facts and circumstances of the case, the submission of the learned Special Public Prosecutor cannot be found faulted as the victim are 24 in number and the total cheated amount is to the tune of Rs.1 crore and 3 thousand. Hence, this Court is of the view that it is not appropriate to consider the bail application at this stage. Hence, this Court is not inclined to enlarge the petitioner on anticipatory bail.

7. Accordingly, this Criminal Original Petition is dismissed. 15-04-2026 SHL To:
