Petitions filed under Article 226 of the Constitution of India to 1/5
issue a Writ of Mandamus directing the respondents to consider the representation dated 04.09.2024 and to pass orders regarding cancellation of enrolment in the newly introduced Contribution Pension Scheme and to bring the petitioners under Old Pension Scheme and to refund of subscription recovered from the petitioners towards New Contributory Pension Scheme as per Rule 11(4) of the Tamil Nadu Pension Rules as amended in G.O.Ms.No.41 Finance (Pension) Department dated 09.02.2010 and the orders of Hon'ble High Court Full Court Judgment in W.A.No.158 of 2016 dated 03.12.2019 and in the 3 light of the orders of this Hon'ble Court in W.P.No.14132/2021 dated 08.07.2021 and consequently government implemented the above Hon'ble High Court Order in G.O.Ms.No.62 Municipal Administration and Water Supply Department dated 07.02.
2024 and to extended the above similar benefits and pass appropriate order within a time limit to be prescribed by this Hon'ble High Court. Contributory Pension Scheme as per Rule 11(4) of the Tamil Nadu Pension Rules as amended in G.O.Ms.No.41 Finance (Pension) Department dated 09.02.2010 and the orders of Hon'ble Full Court of this Court in W.A.No.158 of 2016 dated 03.12.2019 and in the light of the orders of this Court in W.P.No.14132/2021 dated 08.07.2021 and consequently government implemented the order of this Court in G.O.Ms.No.62 Municipal Administration and Water Supply Department dated 07.02.2024 and to extend the above similar benefits and pass appropriate orders within a time limit to be prescribed by this Court. 2.The learned counsel appearing for the petitioner would submit that claiming Old Pension Scheme, the petitioners have given representation on 04.09.2024 and such representation is yet to be considered by the respondents.
3.At this juncture, the learned Additional Government Pleader would fairly submit that the respondents would consider the petitioners' representation within a reasonable time. 4.In such view of the matter, this Court, without going into the merits of the matter, deems it appropriate to direct the respondents 1 3/5
to 4 to consider the above representation of the petitioners upon its own merits and in accordance with law and pass orders, within a period of six weeks from the date of receipt of a copy of this order. 5.The writ petitions are disposed of.
