Prayer:- Criminal Original Petition filed under Section 482 Cr.P.C., to direct the 2nd respondent police to register the case on the basis of the petitioner's complaint dated 20.10.2014. For Petitioner :

ORDER

This petition has been filed to direct the 2nd respondent police to register the case on the basis of the petitioner's complaint dated 20.10.2014.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State.

3. It is seen that earlier the opposite party had removed a Survey stone from the land of the petitioner on 30.03.2013 in https://hcservices.ecourts.gov.in/hcservices/

respect of which, on the complaint given by the petitioner, a case in Cr.No.720 of 2013 for offences under Sections 447, 506(i) and 3

(1) of the TNPPD Act was registered by the police and investigation is in progress. While so, it is now alleged by the petitioner that, again on 18.10.2014, the accused have removed the survey stone from his land in S.No.7/5 in respect of which he has given a complaint dated 20.10.2014 to the Sub Collector, Hosur with a copy marked to the Inspector of Police, Bagalur Police Station.

4. Under such circumstances, the petitioner is directed to give a fresh complaint to the Inspector of Police, Bagalur Police Station, who shall enquire into the same and take action in accordance with the law laid down by the Honourable Apex Court in Lalita Kumari vs. Govt. of U.P. & others [2013 (4) Crimes 243 (SC)].

This Criminal Original Petition is disposed of with the above direction.
