This Civil Miscellaneous Petition is filed praying to condone the delay of 3544 days in filing the petition to set aside the abatemnt caused due to the death of the 4 th appellant-Sellan in the above Second Appeal. 2.Counsel for the respondent is present and he has no objection in allowing this petition.

4.This Court has perused the affidavit filed in support of the petition. Accepting the reasons stated in the affidavit, this Court is inclined to allow this petition.
