A.No.2117 of 2018 in CS.No.563 of 2013 A.No.2117 of 2018 in CS.No.563 of 2013 P.RAJAMANICKAM.,J This application has been filed by the plaintiff under Order XIV Rule 8 of Original Side Rules, High Court, Madras r/w Order XXVI Rules 13 & 14 r/w Order XX Rule 18 and Section 151 of CPC to pass final decree by dividing the suit property in to two equal shares, as per the preliminary decree, and allot one such share to her.

2. When this matter came up for hearing today, the learned counsel for the applicant/plaintiff appeared through video conferencing and the learned counsel for the respondent/defendant appeared for physical hearing.

3. The learned counsel for the plaintiff has submitted that during pendency of this application both the parties have jointly sold the suit property to third party vide Document No.297 of 2021 and shared the sale proceeds equally and hence, nothing survives in this matter. He further submitted that this application may be closed. He also filed a memo to that effect in the Registry on 11.02.2021.
