3. Heard the learned counsel for the appellant and learned counsel for second respondent and perused the records.
4. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, this miscellaneous petition is allowed and the delay of 125 days in paying the deficit court fee is condoned.
5. Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and list the same for admission in due course.
