Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondent to consider the petitioner representation dated 10.02.2026 and consequently conduct an enquiry and take appropriate action under the Wakf Act, 1995 against the persons illegally collecting rent from the properties of Nawab Abdul Nabikhan Mosque Wakf (G.S.No.62), within a time frame fixed by this Hon'ble Court.

By consent, the writ petition is taken up for final disposal at the admission stage itself.

2.The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the respondent to consider the petitioner's representation dated 10.02.2026 and consequently conduct an enquiry and take appropriate action under the Wakf Act, 1995 against the persons illegally collecting rent from the properties of Nawab Abdul Nabikhan Mosque Wakf (G.S.No.62), within a time frame fixed by this Court.

3.The learned counsel appearing for the petitioner submitted that the petitioner is a member of the Nawab Abdul Nabikhan Mosque Wakf, however, the second respondent without any authority is collecting rent from the tenants occupying the Wakf properties and aggrieved by the same, the petitioner made representation to the first respondent, however, there is no response.

4.The learned counsel appearing for the second respondent 2/4

submitted that the first respondent Board vide order dated 22.05.2025 appointed a seven member Committee [one Hereditary Muthavalli and six members] including the second respondent to administer the properties of Nawab Abdul Nabikhan Mosque Wakf and further submitted that the petitioner has filed this writ petition without impleading the appropriate persons as if there is no one to represent Nawab Abdul Nabikhan Mosque Wakf.

5.Since the first respondent Board vide order dated 22.05.2025 appointed a seven member Committee [one Hereditary Muthavalli and six members] including the second respondent to administer the properties of Nawab Abdul Nabikhan Mosque Wakf, the grievance of the petitioner that the second respondent without any authority is collecting rent from the tenants occupying the Wakf properties is not sustainable one. The writ petition is dismissed. However, liberty is granted to the petitioner to approach the Wakf Tribunal for appropriate remedy. No costs.
