ORDER : The Court Made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 5 and 7(3) of Lotteries Regulation Act 1998 in Cr.No.83 of 2021 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner along with the other accused were found in the possession of lottery tickets. The respondent police registered a case against the petitioner and other accused person.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner. 4.The learned Additional Public Prosecutor submitted that the respondent police have seized the lottery tickets from the petitioner and the petitioner is a habitual offender and further submitted that there are four previous cases pending against the petitioner.

5. Taking into consideration the facts and circumstances of the case and also of the fact that the petitioner is a habitual offender and there are four previous cases pending against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
