S.M.Gafoor Sahib, No. 16, Balu Udaiyar Street, Vandavasi Town, Thiruvannamalai District Petitioner(s) Vs The Commissioner Vandavasi Municipality, Vandavasi Town, Thiruvannamalai District and 5 Others Respondent(s) For Petitioner(s): Mr.R.Mubarak Basha For Respondent(s): Mr.Ramesh, SGP for R1 Mr.U.Baranidharan, AGP
ORDER
This Writ Miscellaneous Petition has been filed to implead the son of the 2nd respondent as the 3rd respondent and also the officials relating to the Tamil Nadu Milk Cooperative Society at Madavaram and the District Cooperative Milk Producers Union, Sathuvachari, Vellore as further respondents.
1/4
2.The Writ Petition has been filed complaining that the Tamil Nadu Milk Cooperative Society had granted permission to the 2nd respondent to put up a Aavin Parlour right in front of the existing shop of the petitioner herein. However, the Tamil Nadu Milk Cooperative Society was not impleaded as a party. It is under those circumstances that this Petition has been filed. Further, the 2nd respondent had filed a counter stating that he has nothing to do with the installation of Aavin Parlour. 3.Taking all the factors into consideration, this petition is partly allowed to the extent of impleading the son of the 2nd respondent, B.Ashick as the 3rd respondent in the Writ Petition and the proposed 5th respondent, General Manager / Joint Director of District Co-operative Milk Producers Union, as the 5th respondent.
4.In the petition filed the proposed 5th respondent official had been described as being the General Manager / Joint Director of both Vellore and Thiruvannamalai District, but subsequently, it is informed that the two areas had been bifurcated and the proper area wherein, the instructions could be obtained would be Thiruvannamalai District Co-operative Milk Producers Union.
2/4
5.Therefore, while carry out necessary amendment and impleading the General Manager / Joint Director of District Cooperative Milk Producers Union, the Registry may delete Vellore and retain only Thiruvannamalai. The 4th and 6th proposed respondents are not necessary parties to the writ petition. The impleading petition is therefore partly allowed only with respect to the 3rd and 5th proposed respondents who are to be impleaded as the 3rd and 4th respondents in the Writ Petition. 13-12-2024 smv 3/4
