Respondents PRAYER: Writ Petition is filed under Article 226 of Constitution of India, praying for issuance of Writ of Mandamus, directing the 1st and 2nd respondents to provide adequate police protection while surveying the petitioner's property comprised in S.No.285/1 measuring to an extent of 30 cents situated at Thiyanadurgam Village, Shoolagiri taluk, Krishnagiri

District by considering the petitioner's representation dated 08.02.2025 within a stipulated period.

ORDER

This Writ Petition has been filed seeking a direction to the 1st and 2nd respondents to provide adequate police protection while surveying the petitioner's property comprised in S.No.285/1 measuring to an extent of 30 cents situated at Thiyanadurgam Village, Shoolagiri Taluk, Krishnagiri District, by considering the petitioner's representation dated 08.02.2025

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner owned property comprised in S.No.285/1

admeasuring 30 cents, situated at Thiyanadurgam Village, Shoolagiri Taluk, Krishnagiri District. While being so, there is a title dispute regarding the property and as such, the petitioner and his family members filed a suit in O.S.No.75 of 2002 on the file of the District Munsif Court, Hosur. In fact, a patta was also issued in favour of the petitioner. Thereafter, the petitioner submitted an application for issuance of separate patta. However, when the surveyor came to the property to conduct the survey, the respondents 4 and 5 interfered and obstructed the same. Therefore, the petitioner sought police protection.

If there is any obstructions from the respondents 4 and 5 or any other neighbours during the land survey, the Surveyor can very well approach the second respondent for necessary police protection to survey the petitioner's land. On receipt of such request, the second respondent is directed to conduct enquiry and pass orders to provide adequate police protection to the surveyor while surveying the petitioner's land.

5. With the above directions, this Writ Petition stands disposed of. No costs.
