O R D E R
The petitioner who was arrested and remanded to judicial custody on 24.03.2020 for the offences punishable under Sections 341, 294(b), 392, 397, 336 and 506(ii) of IPC in Crime No.124 of 2020 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner along with other accused waylaid the defacto complainant, abused him in filthy language and also robbed Rs.3000/- and a cell phone from him. Hence, the complaint.
3. The learned Counsel for the petitioner submitted that the petitioner is in no way connected with the alleged offence and he has been falsely implicated in this case. He further submitted that A2 has been released on bail and that the petitioner has been suffering incarceration for more than 70 days from 24.03.2020. Hence he prays for grant of bail to the petitioner.
4. The learned Additional Public Prosecutor submitted that the petitioner is arrayed as A1 and his wife is arrayed as A2. They used to commit robbery by breaking open houses and that the petitioner is involved in five cases. Sofar, 56 sovereigns of gold jewels have been recovered from him. 5. Taking into account the nature of offence and the antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner for the present.
