No.35205 of 2025 dated 07.10.2025 and enforcing the administrative directive issued by the 3rd respondent vide Ka.No..Uo. Mi.Pe/ E.P./ Aluvarpet, Ko. Katu/ A.No.179/ 25-26 dated 12.11.2025 which already ordered the 4th respondent to shift the connection to this own premises within 15 days within a time frame For Petitioner(s):

Mr.V.Venkata Seshaiya Order The Writ Petition is filed against the respondents 1 to 3 to consider the petitioners representation dated 31.10.2025 for the permanent removal/shifting of the commercial electricity service connection from the petitioner's land.

2. The case of the petitioner is that he is the absolute owner of the agricultural land comprised in New Survey No.69/5B2 and New Survey No.69/5a3 situated at Avalurpettai Village, melmalaiyanur Taluk, Villupuram District. The 4th respondent who owns the adjacent land obtained a commercial electricity service connection, however the said service line and the meter board were illegally erected in the petitioner's land. Hence earlier, the petitioner filed a writ petition before this Court, wherein this Court ordered for joint inspection.

In the said inspection, it was proved that the connection was inside the petitioner's land and consequently the service was disconnected on 08.08.2025. Against which, the 4th respondent filed a writ petition, wherein this Court dismissed the said writ petition and granted liberty to the 4th respondent to shift the connection to his own land. Despite such an order of this Court, the 4th respondent did not remove the structures, however in order to protract the issue, he filed . W.P.No.47543 of 2025, for re-survey. Hence, the petitioner sent a detailed representation on 31.10.2025 . Since there is no response on the said representation, the petitioner is before this Court.

3. The learned counsel appearing for the petitioner would submit that it would suffice, if the third respondent is directed to dispose of the representation of the petitioner dated 31.10.2025 on merits and in accordance with law, within a specified period.

4. The learned counsel appearing for the respondents has no objection for such an order being passed by this Court.

5. Heard the learned counsel appearing for the petitioner and learned counsel appearing for the respondents. Since no adverse order is passed against the 4th respondent, notice to the 4th respondent is not necessary.

6. In view of the limited request made by the learned counsel appearing for the petitioner, this Court, without going into the merits of the case, directs the 3rd respondent to consider the representation of the petitioner dated 13.10.2025 and pass appropriate orders on merits and in accordance with law after providing an opportunity of personal hearing to the 4th respondent, within a period of four weeks from the date of receipt of a copy of this order.

7. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
