Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to permit the petitioner to withdraw 75% of the award amount along with entire interest which was deposited by the appellant / insurance company into the credit of M.A.C.T.O.P.No. 3801 of 2012 order date 24.03.2016 on the file of II Judge Mot Accident Claims Tribunal (Court of Small Causes Chennai pending disposal of the CMA No. 2303 of 2017.

Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S. K.V. MUTHU VISAKKAN, Advocate for the petitioner and of M/S/P.SANKARANARAYANAN, Advocate on behalf of the Respondents the court made the following order:- The petitioner/claimant has come forward with this petition seeking to permit him to withdraw 75% of the award amount along with entire interest, which was deposited by the appellant/Insurance Company to the credit of M.A.C.T.O.P.No.3801 of 2012 on the file of the Motor Accident Claims Tribunal, II Small Causes Court, Chennai.

2. Heard the learned counsel for the petitioner/claimant and learned counsel for the respondents.

3. Considering the facts and circumstances of the case, the petitioner/claimant is permitted to withdraw Rs.2,70,000/- of the award amount lying in the deposit with proportionate interest.

4. Accordingly, this petition is allowed.
